Matthew Gaier, partner at Kramer, Dillof, Livingston & Moore, was quoted in an article by Law36o about a New York birth injury case titled NY Docs Roped Back Into Suit Over Newborn’s Brain Damage.

On Wednesday, July 15, 2020, a panel of judges reversed a summary judgment in a suit accusing Drs. Joseph De Christofaro and Swati Aleti-Jacobs of negligence due to a delay in beginning the process of resuscitation of Kimberly Silverio’s newborn, leading to permanent brain damage. 

Claims against both doctors were previously dismissed, but have been revived by the Appellate Division panel. KDLM partner Matthew Gaier, the family’s lawyer, was quoted in Law360 expressing his satisfaction with the outcome:

“I think it was an excellent decision and properly decided. This was a case where a child was born in a bad condition and the people responsible for providing neonatal care basically said this isn’t my responsibility. The Appellate Division recognized that and reinstated the claims.” -Matthew Gaier
